Introduction, Definitions, and Acceptance

This Privacy Policy (the “Policy”) governs your use of the SUPA Services.  The Policy should be read in conjunction with the Terms of Use (“TOU”), as both these documents govern your use of the Services.

Capitalized terms not defined herein shall have the meanings assigned to them in the Terms of Use.  Additional definitions may be made throughout this Policy. They will be recognizable as they will be capitalized, bolded, and in quotation marks. The definitions found in this Policy shall also apply to the TOU. 

 

You must accept the terms of the Policy in order to create a SUPA account and use the SUPA Services.  By using the Services or any part thereof and/or visiting our Websites, you hereby agree to be bound by this Policy without any reservations, modifications, additions or deletions. If you do not agree to all the provisions contained in the Policy, please do not create a SUPA account, visit our Website or use the Services. If you have downloaded an Application and do not agree to all the provisions of the Policy, please delete the Application from your Device. The Policy is a legal and binding agreement between you and us. Any rights not expressly granted herein are reserved.

 

SUPA reserves the right, at any time and without prior notice, to modify or replace the Policy and/or any portion thereof. Any changes to the Policy can be found at this URL or any other URL SUPA so designates in the future. It is your responsibility to check the Policy periodically for changes. Your use of the Website and/or the Services following the posting of any changes to the Policy constitutes acceptance of those changes. If there are any significant changes to the Policy that materially affect the way we treat your information, you may be notified via the email associated with your account or otherwise through the SUPA Services.

What Does This Privacy Policy Cover?

This Policy covers the treatment of personally-identifiable information i.e. any information that identifies an individual, or can be used in conjunction with other information to identify an individual (“Personal Information”) and other information gathered by SUPA in connection with the Services. This Policy also covers SUPA’s treatment of any information (including Personal Information) that SUPA may share with its business partners or other third parties.

 

This Policy does not apply to the general practices and treatment of information (whether personal or not) by third parties that SUPA does not own or control, including, but not limited to, any third party websites or services that you elect to access as part of the Services, including via the Website or Application or via a link from the Website or Application (“Third Party Website”), or to individuals that SUPA does not manage or employ. While we strive to provide our users with access only to those Third Party Websites that share our respect for privacy, we cannot take responsibility for the content or privacy policies of Third Party Websites. We encourage you to carefully review the privacy policies of any Third Party Website you access.

 

Finally, this Policy does not cover any Personal Information you send to SUPA via any non-secured mode of communications such as email, instant messenger or Twitter, as communications via these methods may be subject to interception, loss, or alteration. While we welcome your comments and suggestions sent to us in this manner, we encourage you to carefully examine what Personal Information you send to SUPA via these methods.

 

Collection of Personal Information 

 

SUPA may gather certain information and data which you provide to SUPA while you are using the Services, for example by signing up for an account to use the Services, or making a purchase of a Product. Personal Information is only gathered when provided by you or with your informed consent. Where you have provided Personal Information, it will only be used for the stated purpose, as detailed more specifically in this Policy.

 

Personal Information Collected and Its Uses

The following is a list of some of the Personal Information collected from you when you use the Services and what we use it for. By using the Services, you acknowledge that you are submitting this Personal Information with your informed consent.

 

 

Social Networking Services

 

The Services enable you to post your Workout Information to a SNS as mentioned above. In such a case, your Workout Information is connected to your Personal Information through the SNS, and by posting your Workout Information to your SNS, you accept and agree to such disclosure. If you choose to do this, we will provide information to the applicable SNS as directed by you. You acknowledge and agree that you are solely responsible for your use of any SNS and that it is your responsibility to review the terms of use and privacy policy of the applicable SNS. We will not be responsible or liable for: (1) the content, products, or services on or availability of any SNS; (2) your use of any SNS; or (3) the privacy of security of any of your information that is provided to any SNS with your consent.

 

Security and Encryption of Information

 

SUPA uses only industry best practices (physical, electronic and procedural) in keeping any data collected (including Personal Information) secure. In addition, SUPA uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services, and these third parties have been selected for their high standards of security, both electronic and physical. Information (including Personal Information) gathered through use of the Services is stored with Amazon Web Services, a recognized leader in secure data.

 

Limited Gathering of Information for Statistical, Analytical and Security Purposes

SUPA automatically collects certain information using a third-party analytics program, Google Analytics, to help us understand how our users use the Services, but none of this information identifies you personally. For example, each time you visit the Website, we automatically collect your IP address, browser and computer type, access times, the web page from which you came, and the web page(s) you access (as applicable). We use information collected in this manner to better understand your needs and the needs of the Services users in the aggregate. SUPA also makes use of information gathered for statistical purposes to keep track of the number of visits to the Website, the specific pages on the Website, and users of the Website with a view to introducing improvements.

 

Your IP address and other relevant information may be used in order to trace any fraudulent or criminal activity and/or activity in violation of the Terms of Use. 

 

Limited disclosure of Personal Information to Third Parties

 

Except as provided herein in this Policy, SUPA does not sell, rent, trade, license or otherwise divulge any of its users’ Personal Information to third parties. Only the employees, representatives, subcontractors, officers, agents, or assigns of SUPA are responsible for the management and development of the Services, and only these individuals have access to the Personal Information collected there. These employees, representatives, subcontractors, officers, agents or assigns all have been instructed with regards to proper compliance with the Policy.

 

Notwithstanding anything in the Policy to the contrary, we may share information we have collected about you or that you have submitted (whether Personal Information or not): (1) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims or demands; (2) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person, or any violation of the Terms of Use or this Policy; (3) if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the Services or the Internet in general (such as spamming, denial of service attacks, or attempts to compromise the security of the Services); (4) to a parent company, subsidiaries, joint ventures, or other companies under common control with SUPA or if SUPA merges with another entity, is subject to a corporate reorganization, sells or transfers all or part of its business, assets or shares (in which case we will require that such entity assume our obligations under this Policy, or inform you that you are covered by a new privacy policy).

 

Mailing List Management and Compliance with Anti-Spam Laws

 

SUPA uses Campaign Monitor to manage our mailing list and send emails. Personal Information is transferred to Campaign Monitor in order for the mailing list to function properly and to send you emails which you have opted to receive or have not opted out of receiving.  Campaign Monitor does not use Personal Information for any other purpose, and will not transfer or sell your Personal Information to any other third party without your prior approval. You may unsubscribe from receiving emails from us at any time by changing the notification preferences in your account settings or by unsubscribing via the “Unsubscribe” link at the bottom of any email sent to you.

Secured Payments

 

When making a purchase on the Website, SUPA ensures that Billing Information and other data in connection with your order is encrypted and secure. All purchases made through the Website are processed using a secure https:// connection, and payment processing is handled through the online payment processor Shopify.  Shopify is a recognized leader in secure data for e-commerce.  Shopify is Level 1 PCI compliant and uses 256-bit SSL certificates to keep order details encrypted and secure.

 

No Billing Information is stored on servers controlled by SUPA. Shopify has our permission to store data in connection with Customer purchases (including all Billing Information) on our behalf in order to ensure a secure method of payment and a proof of purchase archive, allowing for the protection of Customers, and for follow-up as needed. This data may be used for Customer validation and registration purposes and/or to trace any fraudulent activities, if necessary. When you make a purchase using Shopify, you are subject to the Terms of Service and Privacy Policy of Shopify, which we encourage you to read.

 

SUPA and Shopify are unaffiliated companies and SUPA has no influence on the operations of Shopify. SUPA shall in no way be held responsible for any losses or damages, direct or indirect, pecuniary or otherwise, resulting from any error or failure on the part of Shopify.

 

You have the option of storing your Billing information to facilitate purchases in the future. This information is displayed, but it is not stored on servers controlled by SUPA. The information is retrieved by your browser from servers controlled by Shopify.

 

Advertisements and Tracking Technology ("Cookies" and Related Technologies)

 

SUPA uses certain tracking technologies such as cookies, pixels, web beacons and other related technologies in connection with the Services in order to track use and to improve the user experience by storing certain data on a user’s computer or Device, including, but not limited to, the following cookies and related technologies:

Please note that deleting or refusing these cookies may reduce your user experience by requiring you to re-enter certain information, including information required to use the Services. Access to and Deletion of Personal Information

Please note that deletion of your Personal Information may prevent you from fully enjoying the Services, and SUPA and/or its representatives shall not be held liable for any losses or damages, direct or indirect, pecuniary or non-pecuniary, resulting from your request to delete your Personal Information and/or your resulting inability to use the Services.

 

Use by Persons Under 13

SUPA and the Services are not meant to be user by persons under the age of 13 and we do not knowingly collect any Personal Information from children under 13. If you are aware of a user under the age of 13 using SUPA, please contact us via email at legal@supa.ai.

 

How Does SUPA Handle Data From International Visitors?

The Services are hosted in the United States and are subject to United States law. We may share your Personal Information as described in this Privacy Policy, with entities  located in countries other than your country. If you are accessing the Services from outside the United States, please be advised that United States law and other countries may not offer the same privacy protections as the law of your jurisdiction.

 

Risks Associated with the Internet and Wireless Data Transmission

 

Despite SUPA’s best efforts to ensure that third parties will not access or obtain your Personal Information through your use of the Services, complete confidentiality and security cannot currently be guaranteed on the Internet and/or where data is transferred via wireless digital technology of any type. Communication via the Internet or wireless technology is subject to interception, loss, or alteration. You acknowledge and agree that SUPA and/or its representatives cannot be held responsible for damages resulting from the transmission of confidential information or Personal Information over the Internet or wireless technology and that such communications are at your own risk.

 

Transfer of Personal Information Outside Your Home Jurisdiction

 

While SUPA is located in the United States, our third party vendors may be located in jurisdictions or countries where the privacy laws may not be as protective as those in your home country, state, province or other governmental jurisdiction, and SUPA may transfer your Personal Information to such countries. Without limiting the generality of the foregoing, by using the Services, users in the European Union acknowledge and agree that their Personal Information may be transferred to the United States, and consent to such transfer.

 

Limitation of Liability

 

SUPA, and/or its representatives, will not be held liable for any losses or damages (pecuniary or otherwise) resulting from the misuse of any information collected by any third party, or any misuse of any information collected through the Services not in violation of the Policy.
